- Successfully defended a lawsuit seeking to overturn a trustee's sale; obtained full award of attorneys' fees against the plaintiff.
- Recovered the entire principal ($267,500) plus 18% interest and the vast majority of the excavation contractor’s attorneys’ fees and costs in a lawsuit against a developer who refused to pay for construction work about which there were no complaints.
- On appeal reversed a trial court’s decision against a developer for a multi-million dollar deficiency judgment and negotiated a substantially more favorable outcome for the developer after the appeal (see MidFirst Bank v. Chase in "Published Decisions" below)
- Obtained a substantial payment for an architect and contractor on work, for a homeowners association, that had gone unpaid for years.
- Used satellite photos to establish that an asphalt contractor had lien priority over the lender, thereby securing a substantial payment for the contractor.
- Negotiated a walk-away dismissal of an action filed against an architect for alleged professional malpractice.
- In litigation involving Arizona anti-deficiency statutes, defeated a lender’s claim for a deficiency on an unoccupied home and obtained a full award of attorneys’ fees (over $29,000) against the lender.
- In a suit filed by a lender for a deficiency after a trustee’s sale of a home, defeated the lender’s attempt to hold a mortgage broker liable for the deficiency, as the lender made a full-credit bid at the sale. ING Bank, FSB v. Mata, 2009 WL 4672797 (D. Ariz. 2009)
- Resolved a number of trademark disputes short of contested litigation.
- Obtained punitive damages against an individual who repeatedly defamed a small business and its owners.
- Successfully defended a charter school in a lease dispute concerning payment of property taxes, and obtained a full attorneys’ fees award against the landlord of over $40,000.
- Defeated a lender’s attempt in bankruptcy court to force a quick sale of undeveloped property near Flagstaff; property ultimately sold for nearly double the lender’s appraised value.
- Resolved a contract dispute on behalf of a local nutritional supplement manufacturer concerning labeling issues.
- Represented mining companies in complex environmental case involving extensive groundwater pollution.
